Kyle Rinella, Kyle Murray, Clinton Ronchetto and Michael Carruthers, the police officers accused of beating a Herrin man last August, say past drug charges against Derek Wynn, the alleged victim, hurts his credibility as a witness.
At a pre-trial hearing Monday morning in Williamson County Circuit Court, defense attorneys told Judge John Speroni that Wynn had been charged by Carbondale Police in 2006 with possession of cocaine and drug paraphernalia.
State’s Attorney Charles Garnati said the case had been dismissed against Wynn, that there were no convictions and no evidence pointing toward Wynn’s guilt.
Attorney Doug Dorris, representing, Kyle Rinella, said he thought Wynn should be present at this Friday’s evidentiary hearing. Garnati said it would be up to the defense to subpoena him.
Speroni said he plans to set a trial date Friday.
